Contact us if you get a bounced, or “worthless” check. Keep the original of the check unless the debtor is willing to pay the full balance including all statutory fees and costs. In Oregon, a creditor can sue to recover on a bounced check and receive statutory damages including treble damages (3 times the amount of the check) plus interest and attorneys fees.
The judgment amount you can receive is significantly higher than the amount of the check.
